AMIGOS TRAVEL TERMS AND CONDITIONS
Travel arrangements made with us are operated by King Island Eco Lodge Pty Ltd, as trustee for The King Island Trust, trading as Amigos Tours & Travel (hereinafter known as “the Company”) ABN 22503417505. By asking us to make travel arrangements on your behalf, whether by phone, email or face to face, you accept all bookings are subject to the following terms and conditions:-
1 – DEPOSIT:
A deposit of an amount requested is to be paid to the Company to make make the arrangements as requested. Many of the ground arrangements and some flights have to be pre-paid in full, so once your itinerary has been confirmed, the deposit is non-refundable.
2 – PERSONAL DETAILS:
It your responsibility to ensure personal details on this form are exactly as per your passport. Errors may cause denial of travel services and the passenger is responsible for any additional charges relating to this.
3 – CONFIRMATION:
Your itinerary is not confirmed until you receive written confirmation from the Company.
4 – TRAVEL INSURANCE:
Personal travel insurance is compulsory. You should be satisfied that your insurance cover fully meets your personal requirements especially in respect to death, personal injury or illness, in all countries travelled to during the itinerary and that it extends until your arrival home. This insurance should also cover against cancellation charges. We recommend that insurance be taken out at the time you pay your deposit. In the event of a claim against a travel insurance policy that has not been purchased through Amigos Travel, we reserve the right to charge an administration fee of $250 to fulfil documentation requests made to us by your insurance company.
5 – PAYMENT OF BALANCE: The balance of the tour must be paid no later than 90 days prior to departure.
6 – PRICE CHANGES: Although highly unlikely, tour prices can increase prior to our receipt of full payment from you due to reasons beyond our control – such as major currency fluctuations, variation of hotel contract rates or airline price increases.
7 – CANCELLATION CHARGES: If you cancel your booking, cancellation charges will be charged according to the following scale.
– more than ninety days prior to departure – forfeit deposit- 90 days or less prior to departure – forfeit payment for all services already prepaid to airlines and ground service suppliers. This may be 100% of the tour cost. – 30 days or less – no refund.
8 – DOCUMENTATION: All documentation, including passports, visas, re-entry permits, vaccination certificates etc. are your responsibility. Any advice given to you on any of these matters is general only and not specific to your circumstance.
9 – EXCLUSIONS: Items not covered in your itinerary: visas, insurance, excess baggage, meals not shown as included, laundry, drinks, souvenirs, tipping, airport entry & departure taxes, vaccinations and items of a personal nature.
10 – BAGGAGE: Baggage is limited to two suitcases of maximum weight 23kg, an airways type shoulder bag or day pack and camera case. This baggage allowance may change for internal flights so please reconfirm this before departure.
11 – EARLY EXIT: In the event of a Passenger not completing the itinerary for any reason, any extra expenses are the Passenger’s responsibility and the Company shall not be liable for any refund, either total or partial, of money paid for any unused services.
12 – PASSENGERS: All passengers must comply with all legislation, visas, immigration, customs, foreign exchange & health regulations of the countries visited.
13 – AUTHORITY: Passengers will accept the authority and decisions of tour leaders and guides appointed by the Company.
14 – THE COMPANYS LIABILITY:
(a) The Passenger hereby agrees that no liability will attach to the Company, its servants or agents in respect of death, personal injury or illness of the Passenger and/or the loss or damage to the property and effects of the Passenger during the course of the itinerary howsoever caused. The Company shall not be liable for any damage, losses or additional expenses suffered as a result of cancellation, sickness, repatriation, accident, delay, late completion of tour, mechanical breakdowns, weather, lockout, Act of God or other causes. The Passenger travels on the full understanding that for certain countries visited, no (or in some cases very limited) passenger liability insurance is available and that he/she therefore travels entirely at his/her own risk. For the purposes of this clause the Company shall be deemed to contract as agents for its servants and its independent contractors as well as on its own behalf. This clause shall not apply so as to exempt the Company from any liability in respect of which the Company is obliged to by law.
(b) If the fulfilment of any tour is rendered impossible, illegal, or in the Company’s opinion inadvisable, by strike, war, epidemic, governmental interference or any other cause beyond the Company’s control, the Company reserves the right to at any time to cancel such tour, or the remainder thereof or to modify the itinerary in any way considered necessary or desirable, and to change any reservation and/or means of conveyance, accommodation or other details thereof that it thinks fit without notice. This would be without allowance or refund but the extra cost, if any, resulting therefrom must be paid by the Passenger. The Passenger shall be bound by any cancellation or alteration made under the provisions of this clause and shall not be entitled to recover any sum paid by him/her. This shall be the full extent of the Company’s liability and the passenger should have personal travel insurance to cover these risks.
